Dr. Apoorva Pauranik and Pauranic Academy of Medical Education Private Limited (collectively referred to as the “Hosts” or “we” or “us”) own and operate the internet source www.neurogyan.com (“Neurogyan”) and all rights attached thereto. For the purposes of these terms and conditions, wherever the context so requires “you” or “User” shall mean any natural or legal person or any entity who uses Neurogyan and/or avails any of the Services (as defined below).

The terms and conditions set out below (the “Terms”) are intended to make you aware of your legal rights and responsibilities in relation to your access to and use of Neurogyan, including, without limitation delivery of services, information or content available on Neurogyan or any other source whether existing now or in the future that link to the Terms (the “Services”).

Please read the Terms and theprivate policy available at [insert the URL for the privacy policy] (“Privacy Policy”) carefully before registering on, accessing, browsing, downloading any content or using Neurogyan, and all associated content linked to Neurogyan.

These Terms and the Privacy Policy collectively constitute a legally binding agreement (“Agreement”) between you and the Hosts in connection with your usage of Neurogyan and availing any of the Services, and are governed by the provisions of the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011, the Indian Contracts Act, 1872 and other applicable laws, rules and regulations. If you disagree with any part of these Terms or the Privacy Policy, please do not use Neurogyan or avail any Services thereof.

  1. Acceptance of the Terms

By registering on, accessing, browsing, downloading any content from or using Neurogyan for any general purpose or for any specific purpose of availing any of the Services, You agree to be bound by the Terms set forth below, and conclude a legally binding contract with Us. You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of Neurogyan is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

In order to use the Services, you must first agree to the Terms. You can accept the Terms by:

You unequivocally declare that you are 18 (eighteen) years old or above, and legally permitted to enterinto a contract in India, in accordance with the applicable laws in India.

You acknowledge and agree that the content, text, data, graphics, images, information, suggestions, guidance and other material (including information provided in direct response to your questions or as part of any web based discussions) that may be available on Neurogyan (“Neurogyan Data”) is solely for information purposes and may be provided by individuals in the medical profession. The provision of such Neurogyan Data does not create a licensed medical professional-patient relationship between the Hosts and you or between such doctors/health care professionals/medical practitioners and you, and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular ailment or condition. The Hosts make no guarantees, representations or warranties, whether expressed or implied, with respect to the professional qualification, quality of work or advice, expertise or other information provided on Neurogyan. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on the Neurogyan Data. 

You understand that Neurogyan provides various Services and content through the website. While most of these Services are currently provided for free, the Hosts may at a later point decide to charge for certain Services and you may then be required to incur costs, if you choose to avail such Services (“Paid Services”). The Hosts may in such event provide billing services either directly or on behalf of the relevant doctors or medical practitioners. Should you wish to avail the Paid Services, you acknowledge that the Hosts will collect the payment for such Paid Services directly or for and on behalf of the doctors and/or medical practitioners providing such Paid Services. You acknowledge and agree that the Hosts shall not be liable for the Paid Services or be treated as a doctor or a health care professional or a medical practitioner on account of such collection of the payments or for provision of the Paid Services, for any reason whatsoever.

All rights, title to, license and interest in the content available on Neurogyan, including without limitation, the content posted by third-party doctors/healthcare professionals/medical practitioners, the look and feel of Neurogyan, the designs, the trademarks, service marks, and trade names displayed on Neurogyan, are the property of the Hosts or its licensors, and are protected by copyrights, trademarks, patents or other proprietary rights and laws.

The Hosts grant you a non-exclusive, non-transferable, revocable, limited license to view, copy, print and distribute content retrieved from Neurogyan only for your personal, non-commercial use, provided that you do not remove or obscure any copyright notice, trademark notice, or other proprietary rights notices displayed on or in conjunction with the content. You may not use any content available on Neurogyan in any other manner or for any other purpose without the prior written consent of the Hosts. All rights not expressly granted in these Terms are expressly reserved to the Hosts. All trademarks, service marks, logos and designs used on Neurogyan, whether registered or unregistered, are owned by the Hosts or other third parties. You may not use or display any trademarks, service marks, logos or designs owned by the Hosts or its affiliates without our prior written consent.

You agree to protect, at all times, our proprietary rights and of other persons having right in the Services. You agree not to use any framing techniques to enclose any intellectual property right (including, trademark, wordmarks, logos, designs, etc.) or other proprietary information of the Hosts, or remove, conceal or obliterate any copyright or other proprietary rights. Any infringement shall lead to appropriate legal proceedings against you at an appropriate forum for seeking all available and possible remedies under applicable laws of India.

We do not guarantee, represent or warranty that your use of the content or information available on Neurogyan will not infringe rights of any third parties not owned or affiliated with us. You agree to immediately notify us upon becoming aware of any claim that the Services or Neruogyan infringe upon any intellectual property rights or other contractual, statutory or equity rights.

If, at our request, you send any specific submissions (e.g., videos, audio, photographs, medical reports, medical history, personal information, sensitive personal data or information, quiz entries, etc.) or without a request from us, you send any of any foregoing information, whether online, by email, by post, or otherwise, or make any such submissions on Neurogyan and/or upload, publish any content through Neurogyan or in connection with the Services, you agree that we may, at any time, without restriction, edit, copy, modify (including placing our name, logos, trademarks, copyright notices or other graphical elements to textual content), adapt, publish, translate and otherwise use in any medium any such content or information that you have submitted to us, and shall further have the right to restrict you or any other User from accessing any such content or information (including the information or content submitted by you) at our sole discretion. We are and shall not be under any obligation to maintain such content or information confidential, to pay any compensation for any such content or information, or to respond to any queries submitted by you.

You may not use a false e-mail address, name or identity, or otherwise mislead or misrepresent us or any third parties. You shall be solely responsible for accuracy of the content or information that you submit to us.

You agree that you will not submit, post, or otherwise make available to us through Neurogyan or any social media account operated by us, any content or information that (i) includes any unauthorised advertising, promotional material, spam, junk mail, or any unsolicited mass e-mail of any nature whatsoever, to persons that have not consented to be a part of it; (ii) is unlawful, harassing, abusive, threatening, indecent, defamatory, harmful, tortuous, obscene, or invasive of other persons’ privacy; (iii) contains any worms, virus, or other harmful, disruptive, or destructive files, codes or programs; (iv) asserts or implies that your information or content is in any way provided, sponsored or endorsed by u; or (v) infringes, violates or trespasses any person’s copyright, trademark, trade secret, patent or any other proprietary right.

You acknowledge and agree that the Hosts do not have any obligation to monitor you, or your access to or use of Neurogyan or the Services for violations of these Terms. That said, we have the right to do so for the purposes of improving the Services or operating them, including for prevention of fraud, risk assessment or investigation.

Neurogyan may display advertisements or promotions for revenue, and these advertisements may be relevant or targeted to the information or content provided on Neurogyan. Further, Neurogyan may also display advertisements or promotional materials submitted to the Hosts by third parties. The Hosts take no responsibility for such advertisements or promotional material, and the responsibility for ensuring that such advertisements or promotional information complies with applicable laws (including, without limitation,the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, as amended from time to time).

Your correspondence with, dealings with, participation in the promotions by, or acting on such advertisements or promotions by, the advertisers found on or through Neurogyan, including any payment and delivery of related goods or services, any other terms, conditions, warranties or representations associated with such dealings, shall be solely between you and such advertisers. The Hosts will not be responsible or liable for any error or omission, inaccuracy in advertising material or any loss or damage of any sort incurred by you in connection therewith.

Further to the other prohibitions or restrictions set out in these Terms, you are prohibited from using or accessing Neurogyan and/or the Services: (i) for any unlawful or immoral purposes; (ii) to violate any local, international, federal, provincial or state regulations, rules, laws or ordinances; (iii) to infringe upon or violate our intellectual property rights or such rights of any other person; (iv) to solicit others to perform or participate in unlawful acts; (v) to harass, abuse, insult, harm, defame, disparage, intimidate or discriminate based on gender, sexual orientation, medical condition, religion, race, age, ethnicity or disability, etc.

You acknowledge and agree that the Hosts have the absolute discretion to deny access to any User or bar any User from using or accessing Neurogyan (including any content available thereon).

  1. Governing law and Dispute Resolution

These Terms and the Privacy Policy are governed by the laws of India, and all Users shall be subject to the jurisdiction of the courts of law at Indore, Madhya Pradesh.

  1. Indemnity

You agree to indemnity and hold us, our affiliates, employees, officers, directors, agents, third-party doctors or healthcare professionals associated with Neurogyan, contractors, third-party associates, licensors, and partners harmless from any and all direct or indirect claims, demands, losses, damages, liabilities, costs and expenses, including without limitation, legal fees and expenses, arising out of or related to your use or misuse of Neurogyan or the Services, and/or any content or information provided by you to us, and/or any violation by of these Terms or the Privacy Policy, or any breach of representations, warranties and covenants made by you in these Terms or your infringement of any of our rights (including intellectual property rights or rights of any other person or entity for any reason whatsoever).

The Hosts reserve an absolute right, at your cost and expense, to assume the exclusive defense and control of any matter whatsoever for which you are required to indemnify us, including the right to settle, and you agree to cooperate with us in relation thereto.

  1. Limitation of Liability

The Hosts assume no responsibility or liability for any consequence relating directly or indirectly to any action or inaction by you in connection with your usage of Neurogyan or the content or information provided by you to us, and the Hosts shall in no event be liable to you for any direct, indirect, specific, incidental, punitive or consequential damages, including but not limited to, any loss of use, loss of profits, data, or any other loss of damages whatsoever, whether for breach of contract, tort (including negligence and strict liability), or otherwise.

  1. Disclaimer

The Hosts disclaim all responsibility, liability, warranty and guarantee for the accuracy and completeness and trueness of any content or information available on Neurogyan, including through the Services (whether provided by the Hosts or any third party).

You agree and acknowledge that the content or information available on Neurogyan or provided through the Services does not establish any engagement of rendering medical, counselling, legal or other professional services or advice. The Services are not intended as medical or healthcare advice or any substitute thereof, or to be used for medical diagnosis or treatment for any problems of any nature (including any professional advice and services from licensed medical practitioner familiar with your unique medical issue or health history).

डॉ. अपूर्व पौराणिक और पौराणिक एकेडमी ऑफ मेडिकल एजुकेशन प्राइवेट लिमिटेड (सम्मिलित रूप से “होस्ट” या “हम” या “हमें” के रूप में संदर्भित) इंटरनेट स्रोत www.neurogyan.com (“न्यूरोज्ञान”) और इससे जुड़े सभी अधिकारों पर स्वामित्व रखते हैं और इसे संचालित करते हैं। इन नियमों और शर्तों के प्रयोजनों के लिए, जहां भी संदर्भ के लिए आवश्यकता हो “आप” या “उपयोगकर्ता” का तात्पर्य किसी भी ऐसे प्राकृतिक या कानूनी व्यक्ति या कोई भी इकाई से होगा जो न्यूरोज्ञान का उपयोग करता है और/या किसी भी सेवा का लाभ उठाता है (जैसा कि नीचे परिभाषित किया गया है)।

नीचे निर्दिष्ट नियम और शर्तों (“नियम”) का उद्देश्य आपको न्यूरोज्ञान साइट को एक्सेस करने (खोलने) और उपयोग करने के संबंध में आपके कानूनी अधिकारों और जिम्मेदारियों से अवगत कराना है, जिसमें न्यूरोज्ञान पर उपलब्ध सेवाओं, जानकारी या सामग्री, या शर्तों (“सेवाओं”) से सम्बद्ध कोई अन्य स्रोत चाहे मौजूदा हो या भविष्य में हो, की बिना किसी सीमा के डिलीवरी शामिल है।

न्यूरोग्यान पर पंजीकरण करने, एक्सेस करने, ब्राउज, डाउनलोड या न्यूरोज्ञान और इससे जुड़ी सभी सम्बद्ध सामग्री का उपयोग करने से पहले उपलब्ध शर्तों और गोपनीयता नीति [गोपनीयता नीति के लिए यूआरएल डालें] (“गोपनीयता नीति”) को ध्यान से पढ़ें।

ये शर्तें और गोपनीयता नीति सम्मिलित रूप से, आपके द्वारा न्यूरोज्ञान के उपयोग और किसी भी सेवा का लाभ उठाने के संबंध में आपके और होस्ट्स के बीच एक कानूनी रूप से बाध्यकारी समझौते (“अनुबंध”) का गठन करती हैं, और सूचना प्रौद्योगिकी अधिनियम, 2000, सूचना प्रौद्योगिकी (उचित सुरक्षा क्रियाएं और प्रक्रियाएं और संवेदनशील व्यक्तिगत जानकारी) नियम, 2011, भारतीय अनुबंध अधिनियम, 1872 और अन्य प्रयोज्य कानून, नियम और विनियम के प्रावधानों के अधीन हैं। यदि आप गोपनीयता नीति या इन शर्तों के किसी भी भाग से असहमत हैं, तो कृपया न्यूरोज्ञान का उपयोग न करें या इसकी किसी भी सेवा का लाभ न उठाएं।

  1. शर्तों की स्वीकृति

न्यूरोज्ञान पर पंजीकरण करने, एक्सेस करने, ब्राउज़ करने, कोई भी सामग्री डाउनलोड करने या किसी भी सामान्य उद्देश्य के लिए या किसी भी सेवा का लाभ उठाने के किसी विशिष्ट उद्देश्य के लिए न्यूरोज्ञान का उपयोग करने से आप निर्दिष्ट शर्तों से बाध्य होने के लिए और कानूनी रूप से बाध्यकारी अनुबंध करने के लिए सहमत हैं। यदि आप शर्तों को स्वीकार नहीं करते हैं या शर्तों से बाध्य होने में असमर्थ हैं, तो आप सेवाओं का उपयोग नहीं कर सकते हैं। आपके द्वारा न्यूरोज्ञान का उपयोग आपके अपने जोखिम पर है, जिसमें यह जोखिम भी शामिल है कि आप आपत्तिजनक, या अन्यथा अनुचित सामग्री के संपर्क में आ सकते हैं।

सेवाओं का उपयोग करने के लिए, आपको पहले शर्तों से सहमत होना होगा। आप शर्तों को निम्न प्रकार से स्वीकार कर सकते हैं:

आप स्पष्ट रूप से घोषणा करते हैं कि आप 18 (अठारह) वर्ष या उससे अधिक उम्र के हैं, और भारत में प्रयोज्य कानूनों के अनुसार आपको कानूनी रूप से भारत में संविदा करने की अनुमति है।

 आप स्वीकृति और सहमति देते हैं कि सामग्री, पाठ्य भाग, डेटा, ग्राफिक्स, चित्र, जानकारी, सुझाव, मार्गदर्शन और अन्य सामग्री (आपके सवालों के सीधे जवाब देते हुए या किसी वेब आधारित चर्चा के हिस्से के रूप में प्रदान की गई जानकारी सहित) जो कि न्यूरोज्ञान (“न्यूरोज्ञान डेटा”) पर उपलब्ध हो सकती है, केवल जानकारी प्रदान करने के उद्देश्य से है और चिकित्सा पेशे से जुड़े व्यक्तियों द्वारा प्रदान की जा सकती है। इस तरह के न्यूरोज्ञान डेटा का प्रदान किया जाना, होस्ट्स और आपके बीच या ऐसे डॉक्टरों / स्वास्थ्य सेवा पेशेवरों / चिकित्सकों और आपके बीच एक लाइसेंस प्राप्त चिकित्सा पेशेवर-रोगी संबंध नहीं बनाता है, और इस डेटा को किसी विशेष बीमारी या स्थिति के लिए राय, वैद्यकीय सलाह, या निदान या उपचार नहीं माना जा सकता। न्यूरोज्ञान पर प्रदान की गई विशेष या अन्य जानकारी, काम की गुणवत्ता या सलाह, या व्यावसायिक योग्यता के संबंध में होस्ट्स किसी प्रकार की व्यक्त या निहित गारंटी, प्रतिनिधित्व या वारंटी नहीं देते हैं। किसी भी स्थिति में हम आपके द्वारा न्यूरोज्ञान डेटा के आधार पर  लिए गए किसी भी निर्णय या कार्य के लिए, आपके या किसी अन्य व्यक्ति के प्रति उत्तरदायी नहीं होंगे।

आप जानते हैं कि न्यूरोज्ञान, वेबसाइट के माध्यम से विभिन्न सेवाएं और सामग्री प्रदान करता है। जबकि इनमें से अधिकांश सेवाएं वर्तमान में निशुल्क प्रदान की जाती हैं, होस्ट्स बाद में कुछ सेवाओं के लिए शुल्क लेने का निर्णय ले सकते हैं और फिर यदि आप इन सेवाओं (“सशुल्क सेवाओं”) का लाभ उठाना चाहेंगे, तो आपको खर्चा करना पड़ सकता है। ऐसी सूरत में होस्ट्स सीधे या संबंधित डॉक्टरों या चिकित्सकों की ओर से बिलिंग सेवाएं प्रदान कर सकते हैं। यदि आप सशुल्क सेवाओं का लाभ उठाना चाहते हैं, तो आप स्वीकृति देते हैं कि होस्ट ऐसी सशुल्क सेवाओं के लिए भुगतान, सीधे या ऐसी सशुल्क सेवाएं प्रदान करने वाले डॉक्टरों और/या चिकित्सकों के लिए और उनकी ओर से एकत्रित करेंगे। आप स्वीकृति और सहमति देते हैं कि होस्ट्स सशुल्क सेवाओं के लिए उत्तरदायी नहीं होंगे, या भुगतान लिए जाने या सशुल्क सेवाएं प्रदान किये जाने के कारण उन्हें किसी भी वजह से डॉक्टर या स्वास्थ्य सेवा पेशेवर या चिकित्सक नहीं समझा जाएगा.

न्यूरोज्ञान पर उपलब्ध सामग्री में सभी अधिकार, स्वत्वाधिकार, लाइसेंस और हित जिसमें बिना किसी सीमा के, तीसरे पक्ष के डॉक्टरों / स्वास्थ्य सेवा पेशेवरों /चिकित्सकों द्वारा पोस्ट की गई सामग्री, न्यूरोज्ञान का रंगरूप, डिजाइन, ट्रेडमार्क, सेवा चिह्न , और न्यूरोज्ञान पर प्रदर्शित व्यापार नाम शामिल है, होस्ट्स या उसके लाइसेंसकर्ताओं की संपत्ति हैं, और कॉपीराइट, ट्रेडमार्क, पेटेंट या अन्य स्वामित्व अधिकारों और कानूनों द्वारा संरक्षित हैं।

होस्ट्स आपको केवल आपके व्यक्तिगत, गैर-व्यावसायिक उपयोग के लिए न्यूरोज्ञान से प्राप्त सामग्री को देखने, कॉपी करने, प्रिंट करने और वितरित करने के लिए एक गैर-अनन्य, अहस्तांतरणीय, प्रतिसंहरणीय, सीमित लाइसेंस प्रदान करते हैं, बशर्ते कि आप सामग्री पर या उसके साथ प्रदर्शित किसी कॉपीराइट नोटिस, ट्रेडमार्क नोटिस, या अन्य स्वामित्व अधिकार नोटिस को हटा या अस्पष्ट नहीं करते हैं। आप होस्ट्स की पूर्व लिखित सहमति के बिना, न्यूरोज्ञान पर उपलब्ध किसी भी सामग्री का उपयोग किसी भी अन्य तरीके से या किसी अन्य उद्देश्य के लिए नहीं कर सकते हैं। इन शर्तों में स्पष्ट रूप से प्रदान नहीं किए गए सभी अधिकार स्पष्ट रूप से मेजबानों के लिए आरक्षित हैं। न्यूरोज्ञान पर उपयोग किए गए सभी पंजीकृत या अपंजीकृत ट्रेडमार्क, सेवा चिह्न, लोगो और डिज़ाइन, होस्ट्स या अन्य तृतीय पक्षों के स्वामित्व में हैं। आप हमारी पूर्व लिखित सहमति के बिना होस्ट्स या उसके सहयोगियों के स्वामित्व के किसी भी ट्रेडमार्क, सेवा चिह्न, लोगो या डिज़ाइन का उपयोग या प्रदर्शन नहीं कर सकते हैं।

आप हर समय, हमारे और सेवाओं में अधिकार रखने वाले अन्य व्यक्तियों के स्वामित्व अधिकारों को संरक्षित करने की सहमति देते  हैं। आप सहमति देते हैं कि आप होस्ट्स की किसी भी बौद्धिक संपदा अधिकार (ट्रेडमार्क, वर्डमार्क, लोगो, डिजाइन, आदि) या अन्य मालिकाना जानकारी को जोड़ने के लिए किसी भी फ़्रेमिंग तकनीक का उपयोग नहीं करेंगे, या किसी भी प्रकार के  कॉपीराइट या अन्य मालिकाना अधिकारों को नहीं हटाएंगे, छिपाएंगे या अस्पष्ट करेंगे। किसी भी प्रकार का उल्लंघन, भारत में प्रयोज्य कानूनों के तहत उपलब्ध और संभावित सभी समाधान पाने के लिए एक उपयुक्त मंच पर आपके खिलाफ उचित कानूनी कार्यवाही का कारण बनेगा।

हम गारंटी, प्रतिनिधित्व या वारंटी नहीं देते हैं कि आपके द्वारा न्यूरोज्ञान पर उपलब्ध सामग्री या जानकारी का उपयोग किसी भी तीसरे पक्ष जो हमारे स्वामित्व में या हमसे संबद्ध नहीं है, के अधिकारों का उल्लंघन नहीं करेगा । आप इस प्रकार के किसी भी दावे के बारे में पता लगने पर कि सेवाएं या न्यूरोज्ञान किसी भी प्रकार की बौद्धिक संपदा अधिकार या अन्य संविदात्मक, वैधानिक या इक्विटी अधिकारों का उल्लंघन करते हैं, हमें तुरंत सूचित करने की सहमति देते हैं। 

यदि, हमारे अनुरोध पर, आप कोई विशिष्ट प्रस्तुति (जैसे, वीडियो, ऑडियो, फोटोग्राफ, चिकित्सा रिपोर्ट, चिकित्सा इतिहास, व्यक्तिगत जानकारी, संवेदनशील व्यक्तिगत डेटा या जानकारी, प्रश्नोत्तरी प्रविष्टियां, आदि) भेजते हैं या हमारे अनुरोध के बिना, आप पूर्वगामी जानकारी में से कोई भी जानकारी  ऑनलाइन/ईमेल/ डाक या अन्यथा द्वारा भेजते हैं या न्यूरोज्ञान पर ऐसी कोई प्रस्तुति भेजते है और/या  न्यूरोज्ञान के माध्यम से या इसकी सेवाओं के संबंध में किसी भी सामग्री को अपलोड, प्रकाशित करते हैं तो आप सहमति देते हैं कि हम किसी भी समय, आपके द्वारा प्रस्तुत सामग्री और जानकारी को बिना किसी प्रतिबंध के, संपादित, कॉपी, संशोधित (पाठ्य सामग्री में हमारा नाम, लोगो, ट्रेडमार्क, कॉपीराइट नोटिस या अन्य ग्राफिकल तत्वों को लगाने सहित), अनुकूलित, प्रकाशित, अनुवादित कर सकते हैं और अन्यथा किसी भी माध्यम में उपयोग कर सकते हैं, और इसके अलावा हमारे पास स्वविवेक पर, आपको या किसी अन्य उपयोगकर्ता को ऐसी किसी भी सामग्री या जानकारी (आपके द्वारा प्रस्तुत की गई जानकारी या सामग्री सहित) को एक्सेस करने से रोकने का अधिकार होगा। हम ऐसी सामग्री या जानकारी को गोपनीय बनाए रखने, ऐसी किसी भी सामग्री या जानकारी के लिए किसी भी मुआवजे का भुगतान करने, या आपके द्वारा प्रस्तुत किए गए किसी भी प्रश्न का उत्तर देने के लिए किसी भी दायित्व के अधीन नहीं हैं।

आप गलत ई-मेल पते, नाम या पहचान का उपयोग नहीं कर सकते हैं, या अन्यथा हमें या किसी तीसरे पक्ष को गुमराह नहीं कर सकते या मिथ्या प्रस्तुति नहीं कर सकते हैं। आपके द्वारा हमें प्रस्तुत की जाने वाली सामग्री या जानकारी की सटीकता के लिए आप पूरी तरह से जिम्मेदार होंगे।

आप सहमति देते हैं कि आप न्यूरोज्ञान या हमारे द्वारा संचालित किसी भी सोशल मीडिया अकाउंट के माध्यम से किसी भी ऐसी सामग्री या जानकारी को प्रस्तुत, पोस्ट या अन्यथा उपलब्ध नहीं कराएंगे, (i) जिसमें उन व्यक्तियों को भेजा गया, कोई भी अनधिकृत विज्ञापन, प्रचार सामग्री, स्पैम, जंक मेल, या किसी भी प्रकृति का अवांछित सामूहिक ई-मेल शामिल है, जिन्होंने इसका हिस्सा बनने के लिए सहमति नहीं दी है; (ii) जो गैर-कानूनी, परेशान करने वाली, अपमानजनक, धमकी भरी, अभद्र, मानहानिकारक, हानिकारक, कपटपूर्ण, अश्लील, या अन्य व्यक्तियों की निजता पर हमला करने वाली है; (iii) जिसमें कोई वर्म, वायरस, या अन्य हानिकारक, अशांतिकारक, या विनाशकारी फ़ाइलें, कोड या प्रोग्राम शामिल हैं; (iv) जिसमें दावा किया जाता है या जिसका अर्थ निकलता है कि आपकी जानकारी या सामग्री किसी भी तरह से आपके द्वारा प्रदान, प्रायोजित या समर्थित है; या (v) जो किसी व्यक्ति के कॉपीराइट, ट्रेडमार्क, व्यापारिक रहस्य, पेटेंट या किसी अन्य स्वामित्व अधिकार का उल्लंघन, अतिक्रमण या अतिचार करता है।

आप स्वीकृति और सहमति देते हैं कि इन शर्तों के उल्लंघन के लिए होस्ट्स का आपकी, या न्यूरोज्ञान या सेवाओं तक आपकी एक्सेस या उपयोग की निगरानी करने का कोई दायित्व नहीं है। इसके बावजूद, हमें धोखाधड़ी की रोकथाम, जोखिम मूल्यांकन या जांच समेत सेवाओं में सुधार या उन्हें संचालित करने के  लिए ऐसा करने का अधिकार है।

न्यूरोज्ञान आय के लिए विज्ञापन या प्रचार प्रदर्शित कर सकता है, और ये विज्ञापन न्यूरोज्ञान पर प्रदान की गई जानकारी या सामग्री के लिए प्रासंगिक या उसकी ओर लक्षित हो सकते हैं। इसके अलावा, न्यूरोज्ञान तीसरे पक्ष द्वारा होस्ट्स को भेजे गए विज्ञापन या प्रचार सामग्री भी प्रदर्शित कर सकता है। होस्ट्स ऐसे विज्ञापनों या प्रचार सामग्री के लिए, और यह सुनिश्चित करने की कोई जिम्मेदारी नहीं लेते हैं कि ऐसे विज्ञापन या प्रचार संबंधी जानकारी प्रयोज्य कानूनों (जिसमें, बिना किसी सीमा के, समय-समय पर संशोधित औषधि और जादुई उपचार (आपत्तिजनक विज्ञापन) अधिनियम, 1954, शामिल है) का अनुपालन करती है।

न्यूरोज्ञान पर या उसके माध्यम से पाए जाने वाले विज्ञापनदाताओं, के साथ आपका पत्राचार, व्यवहार, इनके द्वारा किये गए प्रचार में भागीदारी, या कार्य जिसमें संबंधित सामान या सेवाओं के किसी भी भुगतान और सुपुर्दगी, इस तरह के व्यवहार से जुड़े किसी भी अन्य नियम, शर्तों, वारंटी या अभ्यावेदन शामिल है, पूरी तरह से आपके और ऐसे विज्ञापनदाताओं के बीच होंगे। होस्ट्स विज्ञापन सामग्री में किसी भी प्रकार की त्रुटि या चूक,  गलती या इसके संबंध में आपके हुए किसी भी प्रकार के नुकसान या क्षति के लिए जिम्मेदार या उत्तरदायी नहीं होंगे।

इन शर्तों में निर्धारित अन्य निषेधों या प्रतिबंधों के अलावा, आपको न्यूरोज्ञान और/या इसकी सेवाओं का उपयोग करने या उनका एक्सेस करने की मनाही है: (i) किसी भी गैरकानूनी या अनैतिक उद्देश्यों के लिए; (ii) किसी भी स्थानीय, अंतर्राष्ट्रीय, संघीय, प्रांतीय या राज्य के विनियमों, नियमों, कानूनों या अध्यादेशों का उल्लंघन करने के लिए; (iii) हमारे बौद्धिक संपदा अधिकारों या किसी अन्य व्यक्ति के ऐसे अधिकारों का उल्लंघन या अतिक्रमण करने के लिए; (iv) दूसरों को गैरकानूनी कृत्यों को करने या उनमें भाग लेने के लिए उकसाने के लिए; (v) लिंग, यौन अभिविन्यास, चिकित्सीय स्थिति, धर्म, जाति, आयु, जातीयता या विकलांगता, आदि के आधार पर उत्पीड़न, दुर्व्यवहार, अपमान, नुकसान, बदनामी, नीचा दिखाने, डराने या भेदभाव करने के लिए।

आप स्वीकृति और सहमति देते हैं कि होस्ट्स के पास किसी भी उपयोगकर्ता को न्यूरोज्ञान एक्सेस करने या उपयोग करने से इनकार करने का या किसी भी उपयोगकर्ता को न्यूरोज्ञान (उस पर उपलब्ध किसी भी सामग्री सहित) का उपयोग करने या उसको एक्सेस करने से रोकने का पूर्ण अधिकार है।

  1. शासी कानून और विवाद समाधान

ये शर्तें और गोपनीयता नीति भारत के कानूनों द्वारा शासित हैं, और सभी उपयोगकर्ता इंदौर, मध्य प्रदेश के न्यायालय के अधिकार क्षेत्र के अधीन होंगे।

  1. क्षतिपूर्ति

आप हमें, हमारे सहयोगियों, कर्मचारियों, अधिकारियों, निदेशकों, एजेंट्स, तीसरे पक्ष के डॉक्टरों या न्यूरोज्ञान से जुड़े स्वास्थ्य सेवा पेशेवरों, ठेकेदारों, तीसरे पक्ष के सहयोगियों, लाइसेंसकर्ताओं और भागीदारों को सभी प्रत्यक्ष या अप्रत्यक्ष दावों, तकाजों, हानियों, क्षतियों, देनदारियों, लागतों और खर्चों जिसमें बिना किसी सीमा के, आपके द्वारा न्यूरोज्ञान या सेवाओं के उपयोग या दुरुपयोग, और/या आपके द्वारा हमें प्रदान की गई कोई भी सामग्री या जानकारी, और/या इन शर्तों या गोपनीयता नीति के किसी भी प्रकार के उल्लंघन या इन शर्तों में आपके द्वारा किए गए अभ्यावेदन, वारंटी और अनुबंधों का उल्लंघन या हमारे किसी भी अधिकार (बौद्धिक संपदा अधिकार या किसी भी वजह से किसी अन्य व्यक्ति या इकाई के अधिकारों सहित) के अतिक्रमण से उत्पन्न या संबंधित कानूनी शुल्क और व्यय शामिल है, से सुरक्षित और हानिरहित रखने की सहमति देते हैं। 

होस्ट्स को आपके खर्च पर, किसी भी ऐसे मामले की अनन्य रक्षा और नियंत्रण लेने का पूर्ण अधिकार है, जिसके लिए आपके द्वारा हमें क्षतिपूर्ति दिया जाना अपेक्षित है, जिसमें निपटान का अधिकार भी शामिल है, और आप इस संबंध में हमारे साथ सहयोग करने के लिए सहमति देते हैं।

  1. दायित्व की सीमा

आपके द्वारा प्रदान की गई सामग्री या जानकारी, या न्यूरोज्ञान के उपयोग के संबंध में आपके द्वारा की गई किसी भी कार्रवाई या निष्क्रियता से संबंधित किसी भी परिणाम के लिए होस्ट्स कोई जिम्मेदारी या दायित्व नहीं लेते हैं, और होस्ट्स किसी भी स्थिति में अनुबंध के उल्लंघन, अपकार (लापरवाही और सख्त दायित्व सहित)  या अन्यथा की वजह से होने वाले किसी प्रत्यक्ष, अप्रत्यक्ष, विशिष्ट, आकस्मिक, दंडात्मक या परिणामी नुकसान के लिए, जिसमें उपयोग का लोप, लाभ का लोप, डेटा, या किसी भी अन्य क्षति के नुकसान शामिल हैं लेकिन इन तक सीमित नहीं है, के लिए उत्तरदायी नहीं हैं।

  1. अस्वीकरण

होस्ट्स, न्यूरोज्ञान पर उपलब्ध किसी भी सामग्री या जानकारी जिसमें सेवाएं (चाहे होस्ट्स या किसी तीसरे पक्ष द्वारा प्रदान की गई हो) शामिल है, की सटीकता, पूर्णता और सत्यता के लिए किसी भी प्रकार की जिम्मेदारी, दायित्व, वारंटी और गारंटी को अस्वीकार करते हैं।

आप सहमति और स्वीकृति देते हैं कि न्यूरोज्ञान पर उपलब्ध या इसकी सेवाओं के माध्यम से प्रदान की गई सामग्री या जानकारी से चिकित्सा, परामर्श, कानूनी या अन्य पेशेवर सेवाएं या सलाह प्रदान करने की कोई वचनबद्धता स्थापित नहीं होती है। सेवाएं चिकित्सा या स्वास्थ्य देखभाल सलाह या उसके किसी विकल्प के रूप में अभिप्रेत नहीं है, या इन्हें किसी भी प्रकार की कोई समस्या के चिकित्सीय निदान या उपचार (आपके विशिष्ट चिकित्सीय मुद्दे या स्वास्थ्य इतिहास से परिचित लाइसेंस प्राप्त चिकित्सक से प्राप्त कोई भी पेशेवर सलाह और सेवाओं सहित) के लिए उपयोग नहीं किया जाना चाहिए।
